Abstract

An analysis of the AI Act and EHDS provisions through a critical methodology is needed to understand how these laws might inadvertently sustain existing power dynamics by essentializing the lives of marginalized groups. I employ a postcolonial and intersectional analysis to critique the ways regulations may favor dominant groups while marginalizing others and neglecting multiple coexisting patterns of discrimination. This approach aims to highlight regulatory gaps that fail to address the needs of diverse populations.
