The Hybridization of the fight against crime through non-criminal or BORDERLINE measures: principles, rules, limits and opportunities for an integrated system
The project aims to investigate the growing use of non-criminal or hybrid sanctions in the fight against crime, which blur the lines between criminal and administrative enforcement. It seeks to systematically map and analyze these fragmented legal measures—ranging from confiscation to compliance obligations—in terms of their purposes (integrating, replacing, or preventing criminal law). The research will assess their legal nature, effectiveness, and impact on fundamental principles, ultimately providing best practices and policy recommendations to ensure a more coherent and legitimate punitive framework.
