FROM ROBOLAW PROJECT TO THE NEW EUROPEAN REGULATION FOR SAFE AND RESPONSIBLE ROBOTICS

The European project "RoboLaw", coordinated by Erica Palmerini, professor of private law at Sant'Anna School for Advanced Studies, contributes to the drafting of the new European regulation on robotics, to make it safe and responsible. As part of the activities related to "RoboLaw", Andrea Bertolini, private law researcher at the School, was invited to present his research to the Committee on Legal Affairs (JURI) of the European Parliament in Brussels.

The JURI Committee, which was devoted to the study of legal, ethical and social problems of robotics and has to evaluate the opportunity to adopt new European regulation, will assess Andrea Bertolini’s new proposal - a "risk management" approach which is not focusing on the person “who acted negligently” as individually liable but on the person who is able, under certain circumstances, to minimize risks and deal with negative impacts.

Increase in efficiency of the judicial system improves the regulatory certainty and prevents litigation; risks become more predictable and manageable also through insurance mechanisms and will be distributed among all the subjects who use a specific technology.

Increased legal certainty, increased volumes of investments in technology standardization, the strengthening of the role of the current European organizations for standardization are the topics of the research led by Andrea Bertolini which the European Parliament Committee on Legal Affairs (JURI) can now evaluate, and, eventually, promote the Association for the development of European Robotics.
